Alliance Security In Trouble Again for TCPA Violations

Less than two weeks into the New Year and it’s already looking like it will be a busy one for the legal team at Alliance Security.
On January, 10th in U.S. District Court for the District of New Jersey, a suit has been filed against Alliance Security for TCPA violations.

This isn’t the first time Alliance Security has been in trouble for failing to comply with TCPA requirements. In March 2014, a suit for violation of the Telephone Consumer Protection Act (TCPA) was filed in Tennessee alleging Alliance Security had placed “unsolicited and unwelcome telephone calls to the plaintiff’s cell phone” using a pre-recorded message. The plaintiff in the suit was seeking $50,000 in damages.

But these aren’t the only filings against Alliance Security. In fact, a quick search on Justia.com showed more than a half dozen different filings from individuals claiming to have received unsolicited calls. You can review all of them here.

Will this most recent filing be the last time Alliance Security is faced with civil suit for TCPA violations? Well, considering the number of past filings, probably not. But maybe, just maybe, one of Alliance Security’s New Year resolutions was to ensure they are 100% TCPA-compliant for 2016.

Another Notable TCPA Lawsuit

In August 2014, Capital One Financial Corp and several other companies entered into an agreement to pay over $75 million to end a class action lawsuit. This is the largest proposed cash settlement under the TCPA to date.

About the Telephone Consumer Protection Act

Originally passed in 1991, the Telephone Consumer Protection Act amended the Communications Act of 1934 to restrict telephone solicitations and the use of automated telephone equipment. In 2012, the FCC amended the TCPA guidelines to include text messaging under the umbrella of “automated calls” covered by the Act. In late 2013, many companies took stock and measure of their current processes in regards to consumer express consent to receiving automated calls and, where applicable, made changes to ensure their compliance with TCPA going forward. It would appear that Alliance Security could do with another round of internal audits to bring themselves into compliance.
