Salesman was walking down the street going door to door around 7:00 pm. My spouse was the lucky one to answer the door since I was at my neighbor's.
After about 20 minutes of them talking on the front porch I returned home only to be confronted by both of them. He was a very nice young clean cut salesman from Hawaii. I listened to his pitch about trying to get the APX name out there and he was willing to give us a free security system installed and there would be no other charges except for the $11.00 weekly monitoring and we would have to agree to leave the APX sign in the yard for a period of 39 months.
My spouse asked the salesman about not using their monitoring if we weren't happy, what would we be responsible for then? The salesman responded we only had to keep the sign in the yard for 39 months. After hours of talking about the system we reluctantly agreed, even though we asked him to come back later so we could discuss it. His response was "I don't want you to miss out on it because we are only offering this free deal to a few customers and I wouldn't want you to lose out to one of your neighbors." The more we talked the more he made it sound like a deal by giving us (more points) which is equipment beyond the 8 specified.
To try to shorten the story, 2 young installers showed up. We were never told they were going to be installing in the same night since it was already after 8:30 and we hadn't ate dinner or anything. Mind you were are still talking to the salesman and still have not signed the contract. After installation was done the salesman starting writing up another paper which was the contract and that is when I heard my spouse start yelling "that's it were done here, I don't want it." It all boiled down to him saying there was a $99.00 activation fee. After almost losing his deal, he reluctantly agreed to waive the fee.
By now he has me on the phone with an APX representative, and she's asking me about whether or not I agreed to terms of the contract and if the salesman had explained the fees with me? I told her I hadn't really looked at it my spouse had. She said I needed to look at the contract and see if everything was in agreeance with what we had discussed. I told her it appeared so after only glancing at it. What it boils down to is it's not 11.00 weekly its $44.99 a month and there is also sales tax on that which is another $3.00. The installers were still programming and making adjustments at this time. I still had not signed this contract I wanted to read it. There is so many clauses in there about they can change your rate at anytime as long as they give you notice which I didn't agree with. Also there is a clause that says they are not responsible and can't be held liable if your home is broken into and something is damaged or someone is hurt. Also it says the purchaser is responsible for any repairs and cost if system is damaged other than normal wear and tear but that not what salesman said.
I made a call to the supervisor, in which I asked him the questions and supposedly his response was after the required 39 months of activation we would only be responsible for the $35.00 service call fee but that all equipment is covered by them 100%. So if this is not in writing what rights do we have if damaged by burglar or acts of God? I'm sure they will say "we didn't say that and its not in the contract".
I am so tired by this point I want to go to bed. The installers ran through the programming and what not and then I'm given the phone again to speak with another representative. This time the female is talking so fast I had to get her to repeat herself several times. She asked if I had been given a manual. (I received one as she was asking me). She also wanted to know if they walked me through the system and answered and questions I had. She even asked if they cleaned up but they were still initialing everything at that point.
So now it's after 11:00pm. I'm starving and sleepy before they finally leave. By the way I'm just now signing the contract as they are about to leave. Now I can finally sit down and relax. I notice there is a whole other section to the contract that I didn't even see since the salesman folded it and placed it in the folder given to me. By now I'm looking for the contract and can't find it. It was in the back flap folded to where I couldn't see it except by now I'm falling asleep so I guess I'll have to read it tomorrow.
I'll let you know what other surprises I find. I might end up doing the 3 day cancellation as well. APX needs to allow time for installation other than the same day, especially since it was late at night. They also need to train their salesman better on what to say and fully disclose everything. I am really feeling duped about now. I hope not.
