On July 18th 2009 an APX traveling salesman came to our door pawning an alarm system. We were only convinced to sign up because of their no obligation 3 business-day cancellation option.

After reviewing our budget, this website, and the D- rating for APX on Better Business Bureau we decided to cancel and sent the cancellation via Fax on the 21st of July. I called to confirm their receipt of the Fax a week later (because we were out of town) and "Jim" confirmed that they had received it.

According to the language on the contract cancellation strip, all "payments...will be returned within 10 days following receipt by the seller of your cancellation notice." And "If you do make the goods available to the seller and the seller does not pick them up within 20 days of the date of your notice of cancellation, you may retain or dispose of the goods without any further obligation."

After 10 days (and even now) we had not received any money and finally on the 20th day they called while I was gone and my wife agreed to have them pick up the alarm system NEXT Thursday. Frankly, I want to keep the alarm system and get my money back as stated in the contract. The next day, when I called to tell them this (and that they owed it to me via the terms in the contract)they lady said that is not what they "meant" by it, and that they "of course" have to talk to customers first THEN the cancellation of the agreement goes into effect (10 and 20 days FROM WHEN THEY CALL ME!). I read her the wording of the contract several times (above) and she reiterated her point several times. I told her that the terms of the contract are not contingent on them calling me or what they "meant." I am very aware of how they hold to the letter of the contract when it is in their favor, NEVER letting customers out of a contract early without paying it off.

Unfortunately I will be strong-armed into giving the alarm system back when they come to pick it up. If I don't they will sell their contract to a collections agency and that agency will probably freeze my assets or worse. If I were to take APX to court they would probably win because within that first 20 days (which right now they don't acknowledge) my wife agreed to a later pick-up date.

By the way, when the installers came to my house I asked them not to stand on chairs, (I had already got them a ladder and showed it to them. I went out back to check on the grill and came back to see the print of a guy's bucket on a re-located chair! They also didn't clean up their mess, dust and stuff. They did "offer" though, so that when the lady called I had to say that they did "offer."
